Following a hearing on 3 April 2007, and the close of appeals with no appeals being lodged, Private Plan Change 02/02 (as amended) becomes operative on 13 August 2007.
The Hearing Committee decisions were notified on 05 May 2007.
Background
Nelson City Council received a request from for a change to the Nelson Resouce Management Plan, pursuant to Clause 21 of the First Schedule of the Resource Management Act 1991. The Council has resolved to proceed with notification of this private plan change which was publicly notified on 28 October 2006.
The private plan change proposed to rezone approximately 138.7 hectares of land located between the Marsden and Ngawhatu Valleys from 'Rural' and 'Rural Smallholdings' to a combination of 'Residential, Lower Density Residential and Higher Density Small Holdings.' It also sought to rationalise the boundary and scheduling of the Marsden Cemetery to reflect land owned by .
Submissions closed on 1 December 2006. Four submissions were received.
Further Submissions closed on 23 February 2007 and no further submissions were received.
Outcome
Following a full Council meeting on 5 July 2007, public notice was given on 4 August 2007 that Private Plan Change 05/05 (as amended) and Council Plan Change 06/02 (as notified) will become operative on 13 August 2007. The Nelson Resource Management Plan has been amended.
